Terms of Service

These Terms of Service (“Terms”) govern your use of the CampaignOS platform, websites, and related services (“Service”) operated by Truvo Digital LLC (“CampaignOS”, “we”, “us”). By creating an account, accessing the Service, or sending messages through the Service, you agree to these Terms.

1. Eligibility and accounts

You must be at least 18 years old and authorized to bind the organization you represent. You are responsible for the security of your account credentials and for all activity under your account.

2. Acceptable use

You agree not to use the Service to:

  • Send messages to recipients who have not opted in.
  • Send content that is unlawful, fraudulent, defamatory, harassing, obscene, or that violates the rights of any third party.
  • Send messages prohibited by the CTIA Messaging Principles and Best Practices, applicable carrier rules, the Telephone Consumer Protection Act (TCPA), CAN-SPAM, or other applicable law.
  • Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.
  • Resell or sublicense the Service without our written authorization.

3. SMS messaging

If you use the Service to send SMS messages, you represent and warrant that you have obtained valid prior express consent from each recipient, that you maintain records of such consent, and that you will honor opt-out requests promptly. You are responsible for the content of every message sent under your account.

Subscribers may opt out at any time by replying STOP to any message. Standard message and data rates may apply. Message frequency varies. Reply HELP for help, or contact support@gettruvo.com.

4. Customer data

You retain ownership of the data you upload to the Service (“Customer Data”). You grant CampaignOS a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display Customer Data solely as needed to provide the Service. Our handling of personal information is described in our Privacy Policy.

5. Fees and payment

Subscription fees, message fees, and any pass-through carrier fees are described in your order form or pricing page. Fees are non-refundable except as required by law. We may suspend the Service for non-payment after notice.

6. Compliance

You are solely responsible for compliance with campaign finance laws (including FEC and applicable state rules), telemarketing and messaging laws, and any other laws applicable to your use of the Service. CampaignOS provides tools to help with compliance but does not provide legal advice.

7. Termination

Either party may terminate these Terms at any time. We may suspend or terminate your access immediately if you breach these Terms or if your use creates legal or carrier risk. Upon termination, your right to use the Service ends; sections that by their nature should survive will survive.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THE DELIVERY OF ANY MESSAGE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAMPAIGNOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO CAMPAIGNOS IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You will defend, indemnify, and hold harmless CampaignOS from any claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your Customer Data, your messages, or your breach of these Terms.

11. Changes

We may update these Terms from time to time. Material changes will be communicated via the dashboard or email. Continued use of the Service after the effective date constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Venue for any dispute shall lie exclusively in the state or federal courts located in Leon County, Florida.
